Categorieën variëren van badkamers tot keukens, servicebeurten, vliegmaatschappijen (over lage prijzen - bikini's en lage temperaturen), hernieuwbare energie, een klacht over een vacature (self employed en geen arbeidsrelatie), gratis 0800-nummers, ooglaserbehandeling, luizenapparaat, dieetprogramma, autoreclame, vitaminwater, een bank, positive health clinic, Groupon-actie, reisvergelijker "travelsupermarket", "call girl competition".

Two regional press ads for Sensible Price Kitchens. a. One ad stated "M.F.I IN ADMINISTRATION One Thousand M.F.I Kitchens All Kitchens with Appliances Only £795 Complete". b. The second ad stated "MFI IN ADMINISTRATION 1000 of ex mfi kitchens to clear, full kitchens with appliances only £795 complete".

Servicing Stop Ltd
A radio ad for Servicing Stop Ltd, trading as servicingstop.co.uk, on Absolute Radio. A voice rapped "If you've got yourself a car, you know you've got to keep it serviced. You need a place you can trust and won't make you nervous ... And the really good news, it costs much less than main dealers ...". Singers in the background repeated "You need servicingstop.co.uk" throughout the ad.

Ryanair Ltd
a. A press ad for Ryanair featured a woman sun bathing on a beach and stated "FOR LOW FARES IN 2011 BOOK AT RYANAIR.COM SALE (TRAVEL FEB-MAR) ONE WAY, FROM £8. BOOK TO THE SUN NOW! RYANAIR". A sponsored search ad, for uk2numbers.co.uk, stated "Free 0800 Numbers UK Instant 0800 Number Activation! Free Line Rental. Advanced Service."

Unite The Union Ltd
A national press ad, for a trade union, was headed "What do you think of when you think British Airways?". The ad made various claims about the BA cabin crew dispute, including "Our members want you to always think positively about BA ... But three times in the past two years they have voted overwhelmingly to take industrial action at the airline ... Unite cabin crew members at BA are mainly female, working mums ... The vast majority will dedicate 25 years or more service to the airline ......

Trinity Mirror plc
A competition in the Sunday Mail, to win laser eye treatment stated "We've teamed up with Ultralase, the UK's leading vision correction specialist ... to give one lucky reader free ... laser eye treatment". It also stated "Ultralase has perfected the vision of over 125,000 people using state-of-the-art technology and the highest qualified team of surgeons in the UK. They are also the only laser eye specialist to offer a lifetime care guarantee".

The Maperton Trust
A website for a head lice repelling device stated "The Head Lice Repelling Unit (HELRU) is a small device using the latest technology to repel head lice from infesting children and adults. It is in the form of a badge of the Unicorn and is pinned to the clothing of the individual. It is designed to be completely safe to the wearer. Its effect on head lice is to repel them."

Tony Ferguson UK Ltd
A leaflet, for Tony Ferguson weight loss programme, included three testimonials. The first showed a "before" and "after" photograph of a woman and included the text “Kylie lost 5 1/2 stone". The second stated "I'm less than half the person I used to be ... I weighed 23 1/2 stone. I blitzed my goal weight within the year and am now a size 10 to 12". Text underneath stated "Robyn lost 12 stone in 18 months. The ad showed a "before" picture of Robyn prior to losing weight and an "after" picture...

Optimax Laser Eye Clinics
Three Facebook ads and an online promotion that the complainant saw in July 2010 advertised half-price laser eye surgery. (a) One stated “Enjoy life without glasses Get Half Price Off laser eye surgery with Optimax. Order your Free Info Pack. Click here”. Citroen UK Ltd
A TV ad, for Citroën, featured a cyclist pulling up behind a Citroën C4 at a set of traffic lights on a busy urban street. Other cyclists joined him until there was a large crowd of cyclists pursuing the C4. At the next junction, the C4 pulled away and lost the cyclists, who appeared disappointed until one of them spotted a different C4 travelling in the opposite direction. Allen Kia (UK) Ltd
A press ad, for Kia cars, stated "Allen Kia Birmingham Where new cars cost less ... Kia Rio 1.4 5dr WAS £8,540 NOW £7,840 SAVE £700".

Barclays Bank plc
A TV ad for Barclays Bank, broadcast on 1 February 2011, featured a mechanical machine that produced shoes and had cogs made of giant coins. The voice-over stated “It’s good news that four out of five business lending applications are approved with the support of Barclay’s business managers, to help get things moving again.” On-screen text read “Average acceptance rate between April - Sept. 2010 for all credit applications for businesses up to £5m turnover. Excludes online applications”.

Dr Batras Positive Health Clinic (UK) Ltd
A regional press ad, for Dr Batra’s Positive Health Clinic, was headed “Freedom from ... Psoriasis.” Text stated “Dr Batra’s. World’s largest Homeopathic Healthcare Corporate with a track record in treating Psoriasis now comes to Harley Street. Dr Batra’s is internationally recognised for successfully treating more than 25,000 cases of psoriasis. Chat with our expert doctors between 9am - 4pm”. The ad also featured a logo which stated “Dr Batra’s” and the website address “www.drbartras.com”.

MyCityDeal Ltd
A sales promotion on the website Groupon MyCityDeal was headed "Today's deal: £9 instead of £30 for a 20 Minute Garra Rufa Fish Natural Pedicure for Two People at Wonderfeet". Further text stated "Fine Print - 1 voucher per two people, multiple may be purchased - Voucher valid for 2 months, 7 days per week - No need to book in advance but please take voucher and security codes with you - Please call 07863 XXX XXX for further information - Not valid with other offers".

Optical Express Ltd
A brochure and a TV ad for Optical Express's laser eye surgery. a. The brochure was titled “The vision care specialists” and featured a testimonial from the golfer Padraig Harrington on the inside front cover which stated “I want to be treated by the best and that’s Optical Express”. The brochure contained a variety of claims about Optical Express’s service and the technology they used. The back cover listed a number of comparative claims with ticks and crosses indicating that the listed...

Moneysupermarket.com Ltd
A TV ad, for a travel comparison website, depicted Jedward sitting on sun loungers by a swimming pool. The comedian Omid Djalili approached them and asked how much they had paid for their holiday. One of Jedward said "£300" and the other said "£500". Djalili asked "Where did you find it?" The first said "travelsupermarket" and the second said "travel agent", then "You paid £200 less than me?". An online promotion, for ITV2's Secret Diary of a Call Girl competition, stated "For a chance for you and three friends to win the weekend of a lifetime ... answer the question as seen in the show ... Closing date for online entries is 7th April 2011 at 9.30am. Answer A - B - C ...".

Winkelnering Olympische Spelen London

 Minister Shippers (Volksgezondheid, Welzijn en Sport) antwoord, mede namens de minister van Financiën, vragen van PvdA-Kamerlid Van Dekken over (gedwongen) winkelnering rondom de Olympische spelen 2012 in Londen.

Het gaat erom dat tickets op de officiële site www.olympischespelenlonden.nl slechts kunnen worden besteld met een creditcard van VISA. Het is een autonome keuze van de organisatie, in Nederland heeft NOC*NSF ATP Events Experts als Official Ticket & Travel Agent aangewezen en die accepteert ook andere gangbare betaalwijzen, aldus de minister.

3. Deelt u de mening dat het onwenselijk is dat mensen gedwongen worden om een creditcard aan te schaffen als zij de Olympische Spelen willen bezoeken, omdat creditcard betalingen vaak uitmonden in dure leningen?
3. Indien mensen kaarten bestellen via ATP worden zij niet gedwongen om een creditcard aan te schaffen.

4. Is hier sprake van het misbruik maken van een economische machtspositie, gegeven het feit dat de organisatie van de Olympische Spelen een monopolist is? Kunt u uw antwoord toelichten?
4. Via meerdere kanalen kunnen er tickets gekocht worden. Voor de officiële verkoop vanuit Nederland geldt dat er meerdere betalingsmogelijkheden zijn. Met het oog hierop is uitbuiting of uitsluiting van consumenten of concurrenten niet aan de orde. Van een overtreding van het verbod op misbruik van een economische machtspositie is dan ook geen sprake.

5. Welke acties gaat u ondernemen om de toegankelijkheid en beschikbaarheid van de kaarten voor dit evenement op korte termijn te vergroten? Wilt u zich er voor inzetten dat ook andere betaalmodaliteiten mogelijk zijn, zodat sportliefhebbers de keuze hebben hoe zij willen betalen?
5. Geen. Het feit dat VISA sponsor is van de Olympische Spelen en de keuze dat via de officiële site alleen betaald kan worden met VISA is een verantwoordelijkheid van het organiserend comité.

Onduidelijke PayPal en telefoonkosten Vueling

RCC 5 april 2011, Dossiernr. 2011/00087 (Administratiekosten Vueling)

Reclamerecht. Administratiekosten (creditcard en PayPal) van betaling vlucht onduidelijk. Telefoonkosten van 0900 klantenservicenummer niet vermeld. Verweerder stelt dat kosten duidelijk zijn en zij voldoet aan de wetgeving hieromtrent. Commissie oordeelt dat in uiting omtrent administratiekosten geen duidelijke prijzen zijn gehanteerd dus in strijd is met art. III sub 1 Reclamecode Reisaanbiedingen (RR) en dat uiting omtrent klantenservicenummer de kosten niet vermeld dus in strijd is met art. 8.1 Reclamecode voor telefonische informatiediensten (RTI). Commissie beveelt adverteerder niet meer op dergelijke wijze reclame te maken.

 

 

In het scherm waarop de vluchttarieven staan (scherm 1) staat de mededeling:
“Prijs per traject, ALLES INBEGREPEN”
Naar klager onweersproken heeft gesteld, zijn bij de op dit scherm getoonde tarieven onder meer inbegrepen de kosten voor een creditcardbetaling ad € 9,50.
 
Naar de Commissie eveneens uit de klacht begrijpt, worden, wanneer men betaalt via PayPal, deze kosten ad € 9,50 (voor een creditcardbetaling) eveneens in rekening gebracht, maar wordt daarbij voor de PayPal betaling € 8,50 extra in rekening gebracht.
 
Volgens de webpagina waarop men een keuze kan maken tussen de aangeboden betalingsmethodes, waarvan bij het verweer een uitdraai is overgelegd, worden voor de verschillende betalingsmethodes de volgende kosten (extra) in rekening gebracht:

De Commissie acht het aldus onduidelijk dat er, wanneer men kiest voor een bepaalde betaalwijze (in ieder geval bij een PayPal betaling), kennelijk hogere kosten in rekening worden gebracht dan wanneer men voor een creditcardbetaling kiest.
 
Gelet op het bovenstaande is de Commissie van oordeel dat in de gewraakte uiting geen duidelijke prijzen zijn gehanteerd als bedoeld in artikel III onder 1 RR.
 
De Commissie oordeelt niet over de redelijkheid van de tarieven.
 
Ad 2.
Op grond van artikel 8.1 van de Reclamecode voor Telefonische Informatiediensten, dient, behalve voorafgaande aan de aanvang van de informatiedienst, ook in iedere reclame-uiting voor betaalnummers het tarief dat in rekening wordt gebracht voor deze dienst te worden vermeld. Op de brochure wordt bij het genoemde 0900 nummer het tarief niet vermeld. Aldus zijn deze uiting en de door klager genoemde uitingen op de website, voor zover hierbij eveneens bij betaalnummers het tarief niet is vermeld, in strijd met het voornoemde artikel.

News Group Newspapers Ltd
A national press reader promotion for cosmetic products. The front-page flash stated "FREE EYE MAKE-UP KIT WORTH £24”. Inside the paper, text stated “... To claim your free Fabulous Models Own make-up kit, simply collect TWO out of the three tokens ... then collect your kit from any participating Tesco store* ... Terms and conditions apply". Small print down the side of the page stated “*Includes Tesco supermarkets and Extra stores only. Excludes selected Metro, Express stores and petrol...

Joju Ltd
An ad, in a magazine about sustainable living, was headed "Joju Ltd we design and install solar electricity systems". Further text stated "It has never been a better time to invest in a solar photovoltaic system". A testimonial read "‘If you own a house and can afford the investment, you'd be crazy not to cash in.’ Feed-in tariff sceptic, George Monbiot".

Save Berkeley Vale
A leaflet for the campaign group Save Berkeley Vale, stated "PLANNING APPLICATION ... for Four 120m Wind Turbines at Standle Farm, Stinchcombe ... COMMENTS / OBJECTIONS SHOULD BE MADE NOW ...". The leaflet included a mock up photo, which featured a country landscape with four wind turbines. Text on the photo stated "View from Wick Lane".

Tesco Stores Ltd
A national press ad for Tesco showed a selection of fresh food products; their prices at Tesco and the prices of the same or equivalent products at Asda. Text in a roundel stated "Total Tesco Saving £4.91". Text stated "One place you won't find your fresh food for the weekend? In the Asda Price Guarantee".

Stevenage Homes
A leaflet, for a loan company, was headlined "Don't be tempted by doorstep lenders ...". Text beneath stated "As Christmas is fast approaching you may be starting to think about how you can afford to buy everything you want. Remember the greatest gift you can give your family is the roof over their head. Your rent is your main priority so please think carefully about committing your family to any loans. sit-up Ltd
A teleshopping ad shown on Price Drop TV, for an omelette maker, showed the product being used to cook various foods, including a pie. At the end of the presentation several pies and a pizza were shown next to the product and a close up showed a cross-section of a pie in detail.

Canonbury Publishing Ltd
A mailing, for a home-working scheme, offered a free CD-ROM and step-by-step manual to the first 200 respondents. The ad included an interview with a previous client who claimed to have "made over £100,000 in an hour online". A screenshot showed a PayPal account for one day and displayed a total income of £3,732.73. Text below the table stated "Not bad huh? That's £3,732.73 - in one day!". A falling price auction for a morganite sterling silver ring included an on-screen graphic, indicating the current stock level, that stated "last 7". Vitabiotics

Ad was headlined "ADVANCED NUTRIENTS FOR THE BRAIN" and featured a picture of a box of supplements. Text on the box stated "Vitabiotics neurozan plus To help maintain Brain Function & Performance NUTRIENTS FOR THE BRAIN". Below the product shot, text in a blue box stated "Includes B VITAMINS & VIT D3 AS SHOWN IN NEW RESEARCH", and "B-VITAMINS & THE BRAIN Also includes the specific B vitamins reported in ground-breaking research".
The complainant challenged whether the claims in ad, that recent research had shown that B vitamins could help maintain brain function and mental performance was misleading, because they understood that the research referred to did not support that conclusion.

The ASA considered that the study was not suitable to support claims relating to brain function or mental performance. The ASA therefore concluded that the implied claims that recent research had shown that B vitamins could help maintain brain function and performance had not been substantiated and were misleading.

Breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 3.7 (Substantiation), 15.1 and 15.1.1 (Food, food supplements and associated health and nutrition claims) and 15.7 (Food Supplements and other Vitamins and Minerals). Ad must not appear again in its current form.

Pass n go

A leaflet and directory entry promoted a driving school. A leaflet stated “THE DRIVING SCHOOL WITH THE HIGHEST PASS RATES ... INSTRUCTORS WITH THE HIGHEST PASS RATES ... WE GUARANTEE -THE BEST CUSTOMER SERVICE - THE BEST DRIVING INSTRUCTORS - THE BEST PASS RATES”. A directory entry stated “I’M PASSING WITH PASS’N’GO The Driving School With The Best Pass Rates Guaranteed ...”.

Complainant challenged whether the claims "THE HIGHEST PASS RATES", "best pass rates" and "best driving instructors" could be substantiated, because they believed the company could not know the pass rates of drivers in other companies and because they believed this implied the drivers would be qualified with the top grade.

The ASA considered that HIGHEST PASS RATES" and the "best pass rates" was a comparative, superlative claim which would be understood by consumers to mean that Pass N Go had achieved more driving test passes than its competitors. In the absence of documentary evidence in support of the claims that Pass N Go had HIGHEST PASS RATES" and the "best pass rates, we concluded that the ad was likely to mislead.

And further, because we considered that the claim "Best Pass Rates" was an objective claim which defined the "best driving instructors" as those drivers who had achieved the highest pass rates, and because we had not seen any evidence in support of that claim, we concluded that the ad was likely to mislead.

The ad breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 3.7 (Substantiation) and 3.38 (Other comparisons). The ad must not appear again in its current form.

personal choice

A regional press ad, for snow boots and ice and snow grippers, stated "We aim to dispatch goods within 7 days, but please allow up to 28 days for delivery".

The complainant, who was told the items they ordered were out of stock, two months after they placed the order and paid, challenged whether the ad was misleading.

In the absence of any evidence that demonstrated that the products advertised were available for purchase at the time the ad appeared or that Personal Choice had made a reasonable estimate of demand, the ASA concluded that the ad was misleading.

The ad breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 3.27, 3.28 and 3.29 (Availability). The ad must not appear again in its current form.

Inside Israel - Go Israel als vakantiebestemming

Reclamerecht. Reclame voor land Israël als vakantiebestemming. Reclame in de zin van art. 1 NRC. Niet oneerlijk en misleidend ex art. 8.3 sub c jo. art. 7 NRC.
 
RCC in eerste aanleg. Gewraakte reclame-uitingen prijzen een aantal gebieden in Israel en lokale bezienswaardigheden aan. Daarbij wordt (onder meer) gebruik maakt van kaarten waarop naar de mening van de RCC (in aansluiting op stellingen van Klager hierover) de grenzen tussen de gebieden die wel en niet tot het Israëlische grondgebied horen niet duidelijk worden weergegeven. Eveneens werd misleidend geacht het ontbreken van de vermelding dat er in bepaalde gebieden in Israel veiligheidsrisico's zijn. Essentiële informatie voor nemen van een besluit tot het boeken van een vakantie naar Israel ontbreekt. Strijd met artikel 8.3 sub c jo 7 NRC. Commissie doet aanbeveling niet meer op dergelijke wijze reclame te maken. Uiting is niet nodeloos kwetsend in de zin van art. 4 NRC.

Adverteerder gaat met succes in beroep bij CvB RCC. Klager stelt incidenteel hoger beroep in. Eerst het principaal appel. 

Geen sprake van reclame, louter informatie. Grief faalt. Art. 1 (oud) NRC van toepassing. Onmiskenbaar wordt in de uitingen het "denkbeeld" aangeprezen dat men een reis naar Israël moet maken.

Geen sprake van omissie essentiële informatie. Hoewel niet van belang voor de beoordeling van de grieven in principaal en incidenteel appel, wordt vooropgesteld dat het het bestek van de NRC te buiten gaat om de juistheid van de stellingen van partijen over de status van bepaalde gebieden, alsmede de terzake gebezigde terminologie te duiden.
 
Het College overweegt dat het gebruikelijk is dat in reclamemateriaal voor een land als reisbestemming de positieve aspecten worden (over)belicht en de minder positieve aspecten buiten beschouwing blijven. Bovendien is de conflictueuze situatie in het Midden-Oosten een feit van algemene bekendheid. In het licht van vorenstaande onderzoekt het College of de in het materiaal verstrekte informatie de gemiddelde consument voldoende in staat stelt om een geïnformeerd besluit over Israël als vakantiebestemming te nemen. Die vraag wordt door het College bevestigend beantwoord. r.o. 3.6. "Niet valt in te zien dat de gemiddelde consument door het ontbreken van dergelijke aanduidingen (lees: veiligheidsrisico's en status bepaalde gebieden en aanduiding daarvan op kaart, TG) zal besluiten tot een transactie waartoe hij niet besloten zou hebben indien die gegevens omtrent de bedoelde gebieden wel in de reclame-uitingen zouden zijn vermeld." 

Incidenteel appel

De Commissie had in eerste aanleg de bedoelde gebieden niet mogen aanduiden als "betwiste gebieden", althans als "gebieden waarvan niet internationaal is erkend dat deze tot het grondgebied van Israël behoren". Zoals overwogen in principaal appel, volgt dat een kwalificatie van de bedoelde gebieden niet van belang is voor het antwoord op de vraag of de in strijd met de waarheid of misleidend zijn. Grief faalt.
 
De tweede grief faalt ook, want geen strijd met art. 8.2 sub b NRC.

Uit hetgeen het College in het principale appel heeft overwogen, (...), volgt dat de omstandigheid dat in de onderhavige reclame-uitingen geen specifieke afbakening heeft plaatsgevonden van plaatsen en bezienswaardigheden die wel en niet in de bedoelde gebieden liggen, niet meebrengt dat de uitingen misleidend zijn, ook niet voorzover de uitingen worden getoetst aan artikel 8.2 aanhef en onder b NRC."

Parkeerservice Schiphol - mededeling te absoluut door ontbreken voorbehoud

Reclamerecht. Central Parking en BijSchipholParkeren.nl (BPS) adverteren op de websites www.centralparking.nl en www.bijschipholparkeren.nl voor het tegen een vergoeding overdekt parkeren van de auto van reizigers in de hun parkeergarages. Op klacht van vliegveld Schiphol. Misleidend omtrent beschikbaarheid parkeerlocaties. Afwijzing klacht dat door gebruik aanduiding "Schiphol" op verwarringwekkende wijze aanhaakt bij  naam, merken en diensten van Schiphol, ook geen vergelijking diensten Schiphol. Verzoek verspreiding beslissing als Alert afgewezen.

Schiphol laat eigen recherchedienst en extern bedrijfsrecherchebureau onderzoek instellen naar activiteiten van Central Parking en BPS. Uit rapport volgt dat parkeren van auto's niet gebeurd conform uitingen op de sites. Schiphol klaagt (1) diverse uitingen op sites zijn misleidend, (2) ten onrechte de indruk gewekt dat zij aan Schiphol gelieerd zijn en profiteren op verwarringwekkende wijze van goede naam en merken Schiphol, en (3) uitingen waarover wordt geklaagd een ontoelaatbare vergelijkende reclame vormen. Verzoek om de beslissing van de Commissie als Alert onder de aandacht te brengen van breed publiek.

Verweer: door softwarefout en piekdrukte (herfstvakantie) is de incidentele situatie ontstaan dat meer reserveringen zijn geaccepteerd dan aantal beschikbare parkeerplaatsen. Er wordt niet structureel op deze wijze gehandeld. De aanduiding "Schiphol" wordt alleen gebruikt als geografische aanduiding. Websites wekken niet de indruk dat Central Parking en BPS gelieerd zijn aan Schiphol.

Commissie: fout in software en piekdrukte zijn omstandigheden die voor rekening komen van Central Parking en BPS. Mededeling is te absoluut door het ontbreken van een voorbehoud ten aanzien van beschikbaarheid parkeerlocaties. Wijst klacht toe.

3. Wat hiervan zij, deze omstandigheid dient naar het oordeel van de Commissie voor rekening van adverteerders te komen. Nu op de websites geen enkel voorbehoud daaromtrent is opgenomen, moeten consumenten erop kunnen vertrouwen dat hun auto wordt geparkeerd op de bij de reservering afgesproken parkeerlocatie. Het had op de weg van Central Parking en BSP gelegen klanten door middel van een voorbehoud of melding op hun websites te informeren zodra bleek dat gedurende langere tijd sprake was van overboekingen, ook al was de oorzaak daarvan adverteerders nog niet bekend.

4. Door het ontbreken van een voorbehoud ten aanzien van beschikbaarheid van de aangeboden parkeerlocaties acht de Commissie de mededelingen betreffende de te reserveren parkeerlocaties op de websites www.centralparking.nl en www.bijschipholparkeren.nl te absoluut en daarom in strijd met artikel 8.2 aanhef en sub b NRC. Omdat de gemiddelde consument hierdoor ertoe gebracht kan worden een besluit over het afnemen van een dienst van adverteerders te nemen dat hij anders niet had genomen, zijn de bestreden websites misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

Afwijzing overige klachten: Gebruik aanduiding "Schiphol" toelaatbaar. Aanduiding wordt gebruikt als aanduiding van de plaats waar de aangeboden parkeerdiensten worden uitgevoerd. Verder geen sprake van specifieke vergelijking van diensten Central Parking en BPS met die van Schiphol. Geen aanleiding om beslissing als Alert te verspreiden.

Booking.com acht markt waarbij alle partijen belasting vermelden niet haalbaar

Reclamerecht. Bijzondere Reclamecode Reisaanbiedingen (RR). Misleiding op internet. De website www.booking.com biedt hotel in New York en een hotel in Miami aan. Belastingen worden niet getoond. In een klein kader op één pagina, verder staan kosten onderaan de reserveringsvoorwaarden, die uitsluitend via een hyperlink zijn te achterhalen. Strijd met 8.2, 8.3 en 8.4 NRC en artikel III.1 RR.

Verweer: Advocaat ingeschakeld door normale consument, waarschijnlijk zit er een concurrent achter. Consumenten zijn gewend aan wereldwijde online markt die zich niet beperkt tot NL en EU. Adverteerder acht een markt waarbij alle partijen inclusief belastingen vermelden niet haalbaar. Verzwakking concurrentiepositie als alle prijzen inclusief belasting worden vermeld. Geen strijd met NRC of RR, althans dat de NRC en RR in dit geval niet van toepassing zijn.

Dezelfde website gericht op Duitse bezoekers (geopend vanaf Duits IP-adres) toont wel prijzen inclusief belasting. Aldus advocaat (en kennis) van klaagster. 

Nederlandse RR is van toepassing omdat de reclame-uitingen zijn gericht op de Nederlandse markt. Correcte en duidelijke prijzen inclusief de onvermijdbare kosten moeten worden getoond (art. III lid 1 RR). Ook bij de uitnodigingen tot aankoop (II sub 4 RR) moeten correcte en duidelijke prijzen worden gehanteerd (art IV sub 1 RR). Commissie doet aanbeveling.

Namens klaagster is voldoende aannemelijk gemaakt dat zij geen concurrent is van adverteerder.
 
Klaagster baseert de klacht onder meer op de algemene bepalingen van de Nederlandse Reclame Code. De Commissie zal de klacht toetsen aan de bepalingen van de Reclamecode Reisaanbiedingen, nu deze code een specifieke regeling bevat van de kwestie waarop de klacht betrekking heeft.
 
De Commissie acht de RR van toepassing op de onderhavige reclame-uitingen, nu deze zijn gericht op de Nederlandse markt.
 
In artikel III lid 1 RR is bepaald dat aanbieders zijn gehouden tot het hanteren van correcte en duidelijke prijzen, inclusief de hen op het moment van publicatie bekende onvermijdbare kosten. Gebleken is dat bovenop de in de uitingen vermelde tarieven 14,75% ‘Belasting’ in rekening wordt gebracht en $ 3,50 toeristenbelasting. Op grond van de genoemde bepaling hadden deze kosten moeten zijn inbegrepen bij de op de producties 1b, 1c, 2b en 2c genoemde tarieven. Nu dit niet het geval is, zijn deze reclame-uitingen in strijd met de genoemde bepaling.
 
De uitingen zoals door klaagster zijn overgelegd als productie 1d en 2d zijn uitnodigingen tot aankoop zoals gedefinieerd in artikel II sub 4 RR, waarvoor op grond van artikel IV sub 1 RR geldt dat de adverteerder daarin op dezelfde wijze als in reclame-uitingen conform artikel III 1 RR gehouden is tot het hanteren van correcte en duidelijke prijzen. Ook op deze pagina’s worden de tarieven genoemd zonder de bedoelde belastingen. Aldus zijn deze uitnodigingen tot aankoop in strijd met artikel IV sub 1 RR.

Aer Lingus - vanaf-prijs

Reclamerecht. Bijzondere Reclamecode Reisaanbiedingen. De Januari-aanbieding op www.aerlingus.com was een reis naar Dublin vanaf €34,99 (enkele reis incl. luchthavenbelasting en toeslagen). Tijdens het boeken blijkt de prijs verhoogd te worden met €75,79 voor belasting en toeslagen. Prijs is dus incorrect. Verweer: Genoemde tarieven zijn vanaf-tarieven, onder voorbehoud van beschikbaarheid. Wanneer er geen stoelen meer beschikbaar zijn voor de aanbieding, wordt het tarief hoger. Onderaan de pagina wordt het bedrag van de tax vermeld.

Commissie: gebleken is dat de reis á €34,99 is te boeken. Artikel V sub 1 van de Reclamecode Reisaanbiedingen (RR) bepaalt, dat aanbieders (van reisdiensten) dienen te zorgen voor een redelijke beschikbaarheid van de door hen in reclame-uitingen aangeboden diensten voor de genoemde prijs; dat is ook het geval. Commissie wijst de klacht af.
