Lijst van "probleemvluchten"

Vzr. Rechtbank Zutphen 13 oktober 2011, LJN BT7576 (Transavia Airlines C.V. tegen EUclaim B.V.)

In een kort geding tussen luchtvaartmaatschappij Transavia en EUclaim biedt diensten en verkoopt documenten aan waarmee passagiers claims kunnen indienen ogv EU en nationale wet- en regelgeving, inzake misleiding en onrechtmatig handelen.

De rechter oordeelt dat EUclaim niet misleidt of onrechtmatig handelt. De lijst met probleemvluchten op de website van EUclaim is niet misleidend of onrechtmatig. Omdat EUclaim de informatie krijgt via Schiphol, dat de informatie weer krijgt van Transavia zelf, is het niet aan EUclaim als de informatie niet zou kloppen. Transavia is de bron en eigenaar van de informatie. De door Transavia gestelde negatieve gevolgen of de aantasting van de goede naam zijn niet aannemelijk geworden. De rechter wijst de vorderingen van Transavia af.

4.4. De voorzieningenrechter overweegt dat Transavia de partij is die beschikt over de informatie waarom een vlucht is vertraagd of geannuleerd. Deze informatie is voor het functioneren van Euclaim van belang. Transavia kan echter niet verplicht worden deze informatie aan Euclaim te verschaffen. Het is aan Transavia of ze deze informatie prijsgeeft aan Euclaim. Wanneer Transavia er voor kiest om deze informatie niet aan Euclaim te verschaffen zal Euclaim haar informatie ergens anders vandaan moeten halen. Transavia heeft het echter in haar macht dat Euclaim uitgaat van de juiste informatie door zelf Schiphol te voorzien van de juiste en meest actuele informatie. Dat Euclaim op haar website een lijst publiceert op basis van informatie die zij van Schiphol krijgt en dat deze informatie onjuistheden kan bevatten maakt nog niet dat Euclaim daarmee jegens Transavia onrechtmatig handelt. Ze gebruikt informatie die vrij beschikbaar is en die informatie bevat mogelijk fouten en/of is niet altijd actueel.
Verder is van belang dat de door Transavia gestelde negatieve gevolgen van het gebruiken van de onjuiste informatie geenszins aannemelijk is geworden. Op geen enkele wijze heeft Transavia haar stelling dat haar goede naam wordt aangetast en dat zij overspoeld wordt met claims inzichtelijk gemaakt. Dat Transavia op deze manier door Euclaim “aan de schandpaal” wordt genageld is niet aannemelijk gemaakt. Daar komt bij dat voorshands onvoldoende aannemelijk is dat de door Euclaim verstrekte informatie de perken te buiten gaat. Immers, op de website van Euclaim wordt, veel genuanceerder dan Transavia stelt, informatie verstrekt over probleemvluchten en de mogelijkheid van passagiers om schadevergoeding te krijgen.
Ook is van belang geacht dat uit de website van Euclaim voldoende duidelijk wordt dat het uiteindelijk aan de Inspectie Verkeer en Waterstaat, de Geschillencommissie Luchtvaart of de civiele rechter is om vast te stellen of een passagier van een bepaalde vlucht in aanmerking komt voor compensatie en dat deze partijen niet uitgaan van de informatie zoals die op de site van Euclaim wordt vermeld.
Gelet op het voorgaande komt de vordering onder 1 niet voor toewijzing in aanmerking.

4.5. Evenmin is aannemelijk geworden dat de mededeling dat Euclaim onafhankelijk advies kan geven jegens Transavia onrechtmatig is. Ter onderbouwing hiervan heeft Transavia gesteld dat Euclaim een financieel belang heeft bij het indienen van claims en voor haar voortbestaan afhankelijk is van deze claims. Zonder nadere toelichting, die ontbreekt, valt niet in te zien dat een financieel eigen belang per definitie aan enige onafhankelijkheid in de weg hoeft te staan. Wat daar ook van zij, door Transavia is niet onderbouwd waarom mededeling van Euclaim over haar onafhankelijkheid schade toebrengt aan Transavia en daarmee jegens Transavia onrechtmatig zou kunnen zijn. Terzijde tekent de voorzieningenrechter daar nog bij aan dat ingevolge de door Euclaim gehanteerde voorwaarden, die op haar website staan vermeld, Euclaim bij een door haar namens de passagier succesvol ingediende claim 73% van de hoofdsom verminderd met € 25,00 administratiekosten zal uitbetalen aan de passagier. Het zal derhalve voor eenieder die gebruik maakt van de diensten van Euclaim duidelijk zijn dat Euclaim daar geld aan verdient. Euclaim doet daar ook niet geheimzinnig over, zodat van enige misleiding op dit punt ook geen sprake is.

4.8. Nu niet gezegd kan worden dat de lijst met probleemvluchten op de website van Euclaim jegens Transavia misleidend en onrechtmatig is en niet aannemelijk is geworden dat Euclaim mededelingen doet op haar website die jegens Transavia misleidend en onrechtmatig zijn, bestaat voor het plaatsen van een rectificatie door Euclaim op haar website geen aanleiding. De vordering onder 5 zal daarom eveneens worden afgewezen.

Gratis reparatie

Reclamerecht. Gratis. Televisiecommercial over reparatie ruitschade: goed verzekerd, kost het je niets. Klager stelt dat reparatie niet gratis is, want zijn verzekeraar wilde hem hierdoor geen bonustreden geven.

Voorzitter: De voorzitter is van oordeel dat de klacht de Commissie geen aanleiding zal geven een aanbeveling te doen. Hij overweegt daartoe het volgende.
Uit de mededeling “(…) u bent goed verzekerd, kost u helemaal niets” blijkt dat de vraag of een reparatie niets kost, afhankelijk is van het feit of men “goed verzekerd” is. Aangezien, naar adverteerder stelt en ook voldoende aannemelijk is, niet bij iedere verzekeringsmaatschappij c.q. verzekeringspolis het laten uitvoeren van de in de uiting genoemde reparatie van invloed is op de hoogte van de premie die men bij verlenging van de verzekering moet betalen, acht de voorzitter de klacht ongegrond.

Op grond van het hierboven overwogene wijst de voorzitter de klacht af.

Afbetaling goedkoper dan vermeld

VzRCC 27 juli 2011, Dossiernr. 2011/00582 (Fiat)

Reclamerecht. Folder van Fiat Italia Mania actie met 3,9% rente met prijsvoorbeelden bij verkoop op afbetaling. Klager: Prijsberekeningen zijn niet juist.   Verweerder: inderdaad foutief maand- en totaalbedrag in uiting genoemd. Geen sprake van misleiding, want foute bedragen hoger dan juiste bedragen.
Voorzitter: Commissie zal klacht toewijzen. Erkend dat maand- en totaalbedrag onjuist zijn in uiting. Strijd met art. 2 NRC. Doet aanbeveling.

Als erkend is komen vast te staan dat in het in de uiting gegeven rekenvoorbeeld met een kredietsom van € 7.000 het maandbedrag en het totale bedrag onjuist zijn weergegeven.
De uiting is daarom in strijd met de waarheid als bedoeld in artikel 2 van de Nederlandse Reclame Code (NRC).

Prijzen zonder btw

Reclamerecht. Drie uitingen van Bo-rent met aanprijzing van huurauto's. Klager stelt dat tarieven exclusief btw worden vermeld en uitingen daarom misleidend zijn voor particulieren. Verweerder stelt met name zakelijke klanten te hebben. Op promotiemateriaal, websites, prijsopgaves staat duidelijk dat prijzen exclusief btw zijn.
Voorzitter oordeelt dat de Commissie aanbeveling zal doen. In commercial wordt prijs genoemd zonder vermelding of het inclusief of exclusief btw is. Uit verweer en andere uitingen blijkt prijs exlusief btw te zijn. Op website en op voorkant folder staat prijs exclusief btw. Dergelijke prijsvermelding zonder btw voor goederen die mede aangeboden worden aan particulieren is in strijd met art. 38 Wet op omzetbelasting 1968 en in strijd met art. 2 NRC. Doet aanbeveling.

In de bestreden televisiecommercial is een bestelbus van adverteerder te zien waarop de huurprijs wordt aangeduid met “€ 50,- per dag”. Niet valt te lezen of daaronder staat “exclusief btw”. Op grond van het verweer en de onder b en c genoemde uitingen is echter komen te staan dat in de op de bestelbus vermelde huurprijs geen btw is begrepen. De voorzitter verwijst naar de beslissing van de Commissie van 8 april 2010 in dossier 2010/00241, waarin is overwogen dat een dergelijke prijsvermelding exclusief btw met betrekking tot goederen die (mede) aan particulieren worden aangeboden, zoals in het onderhavige geval, in strijd is met artikel 38 van de Wet op de omzetbelasting 1968 en daarmee in strijd met artikel 2 van de Nederlandse Reclame Code (NRC).

A regional press ad, for a car dealership, appeared on 3 March 2011. It was headlined “CUSTOMER SAVING £3400” and included an image of a car. Further text stated “new model fordfiesta edge 1.25 (60PS) 3-dr New on the road price £12,395 Our on the road price £8,995 HURRY - limited number available for immediate delivery on ‘11’ reg ... ”.

Stammering Cure
A website, on 5 April 2011, with the url www.stammeringcure.org. Text stated "... Discover how to stop stuttering with stammering cure that works ... You can Click Here Now to check out one thing that really helped me with my stammer ...". A number of hyperlinks on the website led to www.killyourstutter.com, a site which advertised a product that claimed to cure a stutter.

Webfusion Ltd
A website for domain names gave prices for various types of domain names including ".co.uk £2.99 a year". Text at the bottom of the home page stated "All prices Ex. VAT".

Virgin Media Ltd

The website also stated "Up to 40% off ALL flights!". Terms and conditions at the bottom of the next page, after clicking on the promotion, stated "Offers available until Tuesday 22nd March. Up to 40% off applies to the airfare only and excludes airport taxes and charges".

A poster advertisement featured a client of Keith Anthony Weight Loss Centres and showed a before photograph of the client also alongside the caption “I’ve lost 4 stone 3lbs in 14 weeks.” The headline stated “Strictly no bars, no sachets, no supplements, no gimmicks.” The advertisement provided a web address and further contact details for the weight loss centres.

Renault
The advertisement featured four men whispering the words of the song I love Rock ‘N Roll while driving with a baby in the back seat. They pulled up to the side of the road to drop the baby with the mother and then continued on driving while singing at the top of their voice. It appeared the men were driving to a sporting event.

The advertisement featured three plastic dolls dressed as insurance workers, and they were sitting around the canteen table talking about car insurance:
FVO (Woman): “And he says… is there anything you can do on the price… and I says… of course there is now Michael have you considered the sex change...what says he?...a sex change… says I ... taking a spanner and making a few adjustments because if you’re to come back a woman say in ten years, we’ve great deals for the mature lady driver.”

Airtricity
The advertisement showed various everyday life scenarios that were powered by Airtricity energy. This included imagery of a sports stadium lit up at night, a hospital ward, the luas, a couple out walking late at night under street lighting and a mother and daughter at bedtime.

The television advertisement featured babushka dolls and the voice over stated the following:
“There is something very different about the eircom bundle. You still get up to 8mb next generation broadband, you still get unlimited local and national calls and you still get 30 minutes to any mobile network. Car Buyers Guide
An advertisement for the Car Buyers Guide featured a couple who were selling their car on the advertisers’ website. The advertisement began with the girl in hot pants and cropped top draped over a car using the automatic feature on a camera to take pictures of herself. Next she was shown uploading the photographs to the advertisers’ website and explaining to her partner that she took some photographs of his car and uploaded them to sell the car. When showing him the photographs she said “I reckon these might sell it.”

Reclamerecht. Uiting op radio en website over actie met gratis accessoires voor CO2 besparing. Klager stelt dat uitingen indruk wekken gratis accessoires te geven voor elke bespaarde gram CO2 uitstoot. Echter, waarde accessoires is beperkt tot maximum van 1500 euro. Verweerder stelt dat uitingen niet suggereren dat er ongelimiteerd accessoires worden verstrekt. Voorwaarden actie zijn duidelijk en volledig.

Commissie oordeelt dat uitingen indruk wekken dat er relatie bestaat tussen omvang CO2 besparing en waarde accessoires. Er wordt geen voorbehoud gemaakt t.a.v. maximale waarde. Mededeling "Hoe schoner je wordt, hoe groter je beloning" te absoluut, daarom sprake van onjuiste informatie (art. 8.2 aanhef NRC). Strijd met art. 7 NRC. Doet aanbeveling.

Grieven: geen sprake van onjuiste informatie. Er wordt niet gesuggereerd dat er een één op één verhouding is tussen besparing CO2 uitstoot en waarde accessoires en ook niet dat er sprake is van ongelimiteerde hoeveelheid accessoires. Op grond van berekening kan consument afgewogen beslissing nemen, daarom valt niet in te zien waarom uiting leidt tot besluit tot transactie welke consument anders niet zou hebben genomen.

CVB: Er wordt directe koppeling gelegd tussen bespaarde CO2 uitstoot en waarde accessoires. Nadere informatie omtrent limiet ontbreekt. Alleen duidelijk na berekening op website. Geen sprake van onjuiste informatie (art. 8.2 aanhef NRC) maar van te laat verstrekken essentiële informatie (art. 8.3 aanhef en onder c NRC). Maximum waarde accessoires diende in uitingen verstrekt te worden. Strijd met art. 7 NRC. Bevestigt beslissing Commissie met wijziging van de gronden.

 

2. Anders dan de Commissie is het College van oordeel dat het feit dat L&P in de gewraakte uitingen geen maximumbedrag voor de gratis accessoires noemt, niet tot het oordeel kan leiden dat sprake is van onjuiste informatie als bedoeld in arti­kel 8.2 aanhef van de Nederlandse Reclame Code (NRC). Wel is het College op grond van het voor­gaande van oordeel dat L&P in de onderhavige reclame-uitingen te laat es­sen­tiële infor­matie verstrekt die de gemid­delde consu­ment nodig heeft om een geïn­for­meerd be­sluit over een transactie te nemen, dit zoals bedoeld in artikel 8.3 aanhef en onder c NRC. Het feit dat men tot een bepaald maximum gratis ac­ces­soires ontvangt als­mede de hoogte daarvan, kunnen immers het besluit van de con­sument tot een trans­actie beïnvloeden. Naar het oordeel van het Col­lege had L&P deze informatie daarom reeds in de gewraakte uitingen dienen te verstrek­ken. Al­dus komt het College, zij het op andere gronden dan de Com­mis­sie, tot het oor­deel dat de uitingen mislei­dend en daardoor oneerlijk zijn in de zin van artikel 7 NRC.
