Uiting Nationale Nederlanden absurd genoeg

RCC 11 juni 2013, dossiernr. 2013/00211A (persoonlijke schademanager)
Terzijdelegging van de klacht. Humoristische wijze. Bevoegdheid. Afwijzing. Het betreft een televisiereclame. De uiting toont een automobiliste (Merel) die bij het wegrijden zowel met de voorkant als de achterkant van de auto ergens tegen aanrijdt. Hierdoor raakt de auto (een Mini) beschadigd. Vervolgens “scheurt” de vrouw door een smalle steeg en neemt zij op gevaarlijke wijze een bocht. Eenmaal tot stilstand gekomen pakt zij de telefoon. Intussen wordt gezegd: “Omdat we willen dat u na schade zorgeloos verder kunt, heeft Nationale Nederlanden verzekering nummer 2: Altijd één vaste, persoonlijke schademanager. En dat schept een band”. Merel belt haar persoonlijke schademanager (Joost) aan wie ze desgevraagd vertelt dat “alles” “heel goed” met haar gaat en vraagt of hij die avond iets te doen heeft. De slotbeelden tonen de Mini die bij avond geparkeerd wordt en de tekst: “Echt iets aan de hand? Neem contact op met ons of uw verzekeringsadviseur”.

De klacht - De reclame zet aan tot misdrijf, namelijk “dood c.q. zwaar lichamelijk letsel door verkeersovertredingen”. In dit geval wordt onverantwoord hard en zonder uitkijken een straat opgereden vanuit een steeg, even smal als de auto. Er is derhalve geen uitzicht. Bij dergelijk roekeloos rijden wordt de schade aan de eigen auto overigens niet vergoed. De reclame is dus ook nog in strijd met de waarheid.

De beslissing tot terzijdelegging van de klacht
De klacht is niet in behandeling genomen omdat deze, naar het oordeel van de voorzitter, niet tot een aanbeveling zal leiden. De voorzitter heeft daartoe onder meer overwogen dat van de commercial niet de boodschap uitgaat dat men de getoonde situaties zou moeten navolgen. Voorts is overwogen dat het feit dat bij de getoonde schadeoorzaken de schade niet zal worden vergoed, niet meebrengt dat de uiting in strijd is met de Nederlandse Reclame Code. Naar het oordeel van de voorzitter wordt op absurde wijze tot uitdrukking gebracht dat men bij adverteerder een persoonlijke schademanager toegewezen krijgt.

Klager verzoekt de Commissie de uiting te verbieden en indien zij daartoe bevoegd is, de adverteerder een boete op te leggen.

Het oordeel van de Commissie
In de bestreden commercial wordt gewezen op het voordeel dat een verzekerde in geval van “verzekering nummer 2” een beroep kan doen op zijn persoonlijke schademanager. Dat gebeurt op duidelijk humoristisch bedoelde wijze, en wel door een situatie te tonen waarbij de verzekerde met plezier haar persoonlijke schademanager benadert, niet zozeer omdat zij schade heeft, maar gelet op de persoon van de schademanager. Gesuggereerd wordt dat ze moedwillig schade wil veroorzaken. In de uiting is duidelijk sprake van een absurde situatie, ook waar het betreft de gevaarlijke manoeuvres van de automobiliste. De Commissie acht het niet aannemelijk dat de uiting kijkers, meer in het bijzonder jongeren, zal aanzetten tot navolging van het gedrag van de vrouw. Ten overvloede overweegt de Commissie dat zij niet bevoegd is adverteerder een boete op te leggen, in het geval zij de klacht gegrond zou hebben geacht.

De beslissing
De Commissie bevestigt de beslissing van de voorzitter en wijst de klacht af.

Folder aan bestaande klanten heeft wervend karakter

RCC 28 maart 2013, dossiernr. 2013/00159 (IZZ - verzekeringen)

Klacht toegewezen. Folder aan bestaande klanten is om te binden en heeft een zeker wervend karakter. Het hoogste aanvullend pakket fysiotherapie vergoedt volledig als het gaat om acute therapie, niet bij chronische therapie.

Uiting: Op de voorpagina van de folder van IZZ staan in een apart kader de “Belangrijkste vergoedingen aanvullende verzekeringen 2013”. Klacht: In de folder staat dat in het hoogste verzekeringspakket fysiotherapie volledig vergoed wordt. Klaagster heeft echter een rekening voor het eigen risico bij fysiotherapiebehandelingen ontvangen, blijkbaar omdat de therapie volgt op een operatie. Nu dit niet in de folder staat, is sprake van “foute reclame”.

De Commissie stelt voorop dat de bestreden uiting aangemerkt dient te worden als reclame in de zin van artikel 1 NRC. De folder bevat niet louter feitelijke informatie over de wijzigingen in de verzekeringspakketten in 2013, maar is kennelijk mede gericht op het aan zich binden van bestaande klanten en heeft daarom ook een zeker wervend karakter.

Op de voorpagina van de bestreden folder staat in het schema met de “belangrijkste vergoedingen aanvullende verzekeringen 2013” met betrekking tot de vergoeding van fysiotherapie  onder IZZ Zorg voor de Zorg Extra 3: “100%”. Als erkend is echter komen vast te staan dat fysiotherapie vanuit deze meest uitgebreide aanvullende verzekering alleen volledig wordt vergoed indien de behandeling wordt aangemerkt als ‘acute therapie’ en niet indien sprake is van ‘chronische therapie’. In het laatste geval vindt - vanaf de 21e behandeling - vergoeding plaats vanuit de basisverzekering, waarvoor een (verplicht) eigen risico geldt. Dit onderscheid tussen acute en chronische behandelingen betekent een belangrijke beperking van de in de folder absoluut gestelde mededeling dat de vergoeding voor fysiotherapie onder Zorg Extra 3 100% bedraagt, en betreft daarom voor de gemiddelde consument essentiële informatie. Dit geldt temeer nu ervan uit mag worden gegaan dat een volledige vergoeding van fysiotherapeutische behandelingen met name chronische patiënten zal aanspreken.
Om de gemiddelde consument in staat te stellen een geïnformeerd besluit te nemen over de aanvullende verzekeringen van IZZ, had in de folder duidelijk moeten worden gemaakt dat een volledige vergoeding van fysiotherapie vanuit pakket 3 alleen in bepaalde - als acuut aan te merken - gevallen plaatsvindt. Een algemene verwijzing naar de verzekeringsvoorwaarden aan het eind van de folder is onvoldoende om de consument op deze beperking attent te maken, nog daargelaten dat naar het oordeel van de Commissie uit de voorwaarden niet duidelijk blijkt waar een toelichting op het onderscheid tussen acute en chronische behandelingen en bijbehorende vergoedingen te vinden is.

'Bijwerkingen' in een uiting

RCC 29 maart 2012, dossiernr. 2012/00065 (Zorgverzekeraar, bijwerkingen)

In de uiting komt naar voren dat een vrouw weet van welke medicatie zij bijwerkingen krijg, zij mag zelf kiezen van de zorgverzekeraar welke medicijnen zij gebruikt. De klager heeft bezwaren tegen die als volgt kunnen worden samengevat:
- Bijwerkingen verhinderen niet per definitie daarnaast een goede werking.
- Gesuggereerd wordt dat er medicijnen bestaan die geen bijwerkingen hebben. Dit is niet het geval.
- Gesuggereerd wordt dat bijwerkingen per definitie nadelig of hinderlijk zijn. Ook dit is onjuist
- Tot slot wordt (ten onrechte) op angstgevoelens ingespeeld)

De RCC stelt - kort gezegd - dat de mededeling slechts ter illustratie dient van de keuzevrijheid bij deze zorgverzekeraar, er is geen sprake van misleiding noch appelleert de uiting aan angstgevoelens.

In de reclame worden twee voordelen genoemd die gelden voor mensen die zijn verzekerd bij zorgverzekeraar ONVZ, te weten dat men zelf keuzes mag maken met betrekking tot arts, ziekenhuis of medicijnen en dat deskundige zorgconsulenten haar klanten van advies kunnen voorzien. Als voorbeeld komt een vrouw aan het woord, kennelijk verzekerd bij ONVZ, die vertelt dat zij nu weet welk merk medicijn goed werkt en van welke medicijnen zij bijwerkingen krijgt. Zij vertelt dat ze om die reden blij is dat ze zelf mag kiezen. Duidelijk blijkt aldus dat de boodschap is dat men bij adverteerder keuzevrijheid heeft en zich daarbij kan laten adviseren door zorgconsulenten. De mededeling met betrekking tot de bijwerkingen dient slechts ter illustratie van dit laatste en heeft betrekking op de persoonlijke situatie van de vrouw die aan het woord is. Naar het oordeel van de Commissie wordt niet gesteld dat bijwerkingen in het algemeen een goede werking verhinderen of dat er medicijnen zouden bestaan die geen (nadelige of hinderlijke) bijwerkingen hebben.

Stoppen met roken niet meer vergoed

Vz (toewijzing) RCC 5 december 2011, dossiernr. 2011/01067 (stoppen-met-rokenorganisatie)

Prostop hanteert een uiting die misleidend is, aldus klager. Zonder feitelijke grondslag wordt gesuggereerd dat de dreiging groot is dat stoppen met roken volgend jaar niet meer vanuit het collectieve basiszorgpakket wordt vergoed. Klager stelt dat de meeste vormen van gedragsbegeleiding ook in 2012 onderdeel van het basiszorgpakket blijven en dat uitsluitend ondersteunende medicijnen in 2012 niet langer vergoed worden. De voorzitter wijst de klacht toe op basis van 8.2 NRC, onduidelijke informatie en daardoor oneerlijk ex 7 NRC.

De uiting spreekt over, o.a. “Het lijkt erop dat de vergoeding voor hulp bij stoppen met roken met ingang van 2012 weer wordt geschrapt.” en “Op dit moment wordt begeleiding bij het stoppen met roken vergoed door iedere zorgverzekeraar, ongeacht uw maatschappij of polis. Daarom is het verstandig om op tijd een afspraak te maken en gebruik te maken van deze regeling voordat de zorgverzekeraars deze ondersteuning in 2012 niet meer dekken.”

De Voorzitter:

Aldus wordt naar het oordeel van de voorzitter in de reclame-uiting gesuggereerd dat vanuit de regering het voornemen is om met ingang van 2012 de vergoedingsregeling in verband met hulp bij stoppen met roken in zijn geheel te schrappen. Klager heeft echter gemotiveerd aangevoerd dat dit voornemen slechts geldt voor bepaalde onderdelen van de hulp bij het stoppen met roken. Adverteerder heeft klagers stelling niet, althans onvoldoende weersproken.

Gelet op het voorgaande is de in de uiting gewekte suggestie niet dan wel onvoldoende aannemelijk gemaakt en is de voorzitter van oordeel dat adverteerder onjuiste dan wel onduidelijke informatie verstrekt als bedoeld in artikel 8.2 van de Nederlandse Reclame Code (NRC). Voorts is de voorzitter van oordeel dat de gemiddelde consument hierdoor ertoe gebracht kan worden een besluit te nemen over een transactie, dat hij anders niet had genomen. Om die reden is de uiting misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

RB 1132

Gratis reparatie

Vz.RCC 7 september 2011, Dossiernr. 2011/00730 (Ruitschade)

Reclamerecht. Gratis. Televisiecommercial over reparatie ruitschade: goed verzekerd, kost het je niets. Klager stelt dat reparatie niet gratis is, want zijn verzekeraar wilde hem hierdoor geen bonustreden geven.

Voorzitter: De voorzitter is van oordeel dat de klacht de Commissie geen aanleiding zal geven een aanbeveling te doen. Hij overweegt daartoe het volgende.
Uit de mededeling “(…) u bent goed verzekerd, kost u helemaal niets” blijkt dat de vraag of een reparatie niets kost, afhankelijk is van het feit of men “goed verzekerd” is. Aangezien, naar adverteerder stelt en ook voldoende aannemelijk is, niet bij iedere verzekeringsmaatschappij c.q. verzekeringspolis het laten uitvoeren van de in de uiting genoemde reparatie van invloed is op de hoogte van de premie die men bij verlenging van de verzekering moet betalen, acht de voorzitter de klacht ongegrond.

Op grond van het hierboven overwogene wijst de voorzitter de klacht af.

Duidelijk een voorbeeld

Uiting: ”Dit is Brigitte Bakker. Brigitte ontdekte vorige week een knobbeltje in haar borst. Over twee weken kon ze pas terecht in het ziekenhuis. Daar zag ze zo tegenop, dat ze Menzis belde om haar te helpen. En dat lukte. Morgen kan ze langskomen. Menzis heeft dan ook speciale afspraken met ziekenhuizen waardoor je in zo’n geval binnen drie werkdagen geholpen wordt. Want elk mens is er één. Juist de mens die onzeker is.”

Klaagster stelt dat de commercial misleidend en onjuist is, omdat daarin ten onrechte wordt gesuggereerd dat:
1) adverteerder patiënten naar een ziekenhuis kan verwijzen (alleen een huisarts of medisch specialist kan patiënten naar een ziekenhuis verwijzen),
2) verzekerden van adverteerder altijd de volgende dag in een ziekenhuis terecht kunnen (in dagelijkse praktijk is dit doorgaans niet mogelijk),
3) verzekerden van adverteerder een voorrangspositie hebben ten opzichte van verzekerden bij andere zorgverzekeraars.

Commissie wijst de klachten af, er worden geen onware statistische gegevens genoemd. College van Beroep bevestigd oordeel van de commissie en voegt toe dat het gaat om presentatie van een individueel geval, in de reclame wordt duidelijk een voorbeeld gegeven. Wachttijden zijn aan veranderingen onderhevig; geen aanvoering van statistieken of de beperkte houdbaarheid daarvan.

1. Gelet op enerzijds de verwijzing van IKNO in het beroepschrift naar de repliek en de pleitnota in eerste aanleg en anderzijds de toelichting van IKNO ter vergadering,  vat het College de grieven op in die zin dat deze zich richten tegen de volgende drie oordelen van de Commissie, neergelegd in onderdeel 8.6 van de beslissing van de Commissie:
- er wordt geen onjuiste of misleidende reclame gemaakt;
- er worden geen onware statistische gegevens genoemd en
- er wordt niet op zodanige wijze reclame gemaakt, dat wordt geappelleerd aan gevoelens van angst.
Deze grieven lenen zich voor gezamenlijke behandeling.
 
2. In de gewraakte uiting wordt de aandacht gevestigd op de mogelijkheid om, na het ontdekken van een knobbeltje in de borst, binnen 3 werkdagen een ziekenhuis te bezoeken, en wel via bemiddeling door Menzis. Tussen partijen is niet in geschil dat Menzis in zodanige bemiddeling voorziet.
Ter aanprijzing hiervan wordt in de gewraakte reclame aangeknoopt bij het individuele geval van “Brigitte Bakker”, die pas over twee weken terecht “kon” in het ziekenhuis. IKNO heeft niet weerspoken dat het voorkomt dat patiënten met een knobbeltje in de borst twee weken moeten wachten, voordat zij in het ziekenhuis terecht kunnen. Meer in het bijzonder heeft de Commissie geoordeeld dat er op dit moment nog een reële mogelijkheid bestaat dat een persoon met een knobbeltje in de borst veertien dagen moet wachten voor een eerste consult in het ziekenhuis en heeft IKNO dat oordeel in hoger beroep niet bestreden.
Niet kan worden geoordeeld dat in de uiting de suggestie besloten ligt dat een wachttijd van twee weken gebruikelijk of gemiddeld zou zijn. In de reclame wordt duidelijk een voorbeeld gegeven.
Gelet op het bovenstaande kan niet worden geoordeeld dat in de uiting onjuiste informatie wordt gegeven als bedoeld in artikel 8.2 NRC.
 
3. In grief III stelt IKNO dat in de reclame niet wordt gewezen op “de beperkte geldigheid van de gebruikte statistieken (gegevens over toegangstijd)” en dat “het gegeven” “dat de wachttijd al snel twee weken bedraagt”, sterk aan verandering onderhevig is.
Zoals hiervoor overwogen, betreft de in de uiting genoemde wachttijd van twee weken duidelijk een voorbeeld. Niet kan worden geoordeeld dat deze vermelding  duidt op het gebruik van statistieken. Reeds daarom kan grief III niet slagen.
 
4. Van de wijze waarop Menzis de kijker attendeert op de door haar gemaakte “speciale afspraken met ziekenhuizen”, waardoor men, in geval van een knobbeltje in de borst, binnen drie werkdagen in een ziekenhuis terecht kan, kan niet worden geoordeeld dat daardoor wordt geappelleerd aan gevoelens van angst. Zoals hiervoor overwogen, ligt in de uiting niet de suggestie besloten dat een wachttijd van twee weken gebruikelijk zou zijn. Afgezien van het ene, desbetreffende voorbeeld laat Menzis zich in de gewraakte reclame niet uit over de wachttijd zoals die geldt, wanneer men geen gebruik maakt  van de regeling van Menzis. In het midden blijft of anders dan via Menzis ook een kortere wachttijd kan worden gerealiseerd.
Aan het bovenstaande doet niet af dat de bewuste televisiereclame betrekking heeft op een onderwerp, het ontdekken van een knobbeltje in de borst, dat onmiskenbaar gevoelens van angst en/of onzekerheid kan veroorzaken.

No Nonsense Insurance
The advertisement featured three plastic dolls dressed as insurance workers, and they were sitting around the canteen table talking about car insurance:
FVO (Woman): “And he says… is there anything you can do on the price… and I says… of course there is now Michael have you considered the sex change...what says he?...a sex change… says I ... taking a spanner and making a few adjustments because if you’re to come back a woman say in ten years, we’ve great deals for the mature lady driver.”

Airtricity
The advertisement showed various everyday life scenarios that were powered by Airtricity energy. This included imagery of a sports stadium lit up at night, a hospital ward, the luas, a couple out walking late at night under street lighting and a mother and daughter at bedtime.

The television advertisement featured babushka dolls and the voice over stated the following:

Car Buyers Guide
An advertisement for the Car Buyers Guide featured a couple who were selling their car on the advertisers’ website. The advertisement began with the girl in hot pants and cropped top draped over a car using the automatic feature on a camera to take pictures of herself. Next she was shown uploading the photographs to the advertisers’ website and explaining to her partner that she took some photographs of his car and uploaded them to sell the car. When showing him the photographs she said “I reckon these might sell it.”
