Syoss; professional = toelaatbare overdrijving

CVB 10 maart 2011, dossiernummer 2010/00695 (Syoss professionele haarproducten) met dank aan Ady van Nieuwenhuizen, Ploum Lodder Princen.

Reclamerecht. Product: persoonlijke verzorging, haarverzorging. Uitingen op website www.syoss.nl en twee tv-commercials. Volgens klager wordt consument misleid: Syoss wordt in kappersbranche gebruikt, echter wordt niet geleverd aan kapsalons of professionele kappers. RCC: Consument ziet voldoende dat het niet gaat om een exclusief product voor kappers, toelaatbare overdrijving wordt ook door consument verondersteld. Geen vergelijkende reclame (13 NRC) nu er geen sprake is van expliciet of impliciet noemen van een concurrent. RCC wijst de klacht af.

Klager gaat in beroep. Kern van de klacht: ten onrechte wordt de indruk gewekt dat de Syoss-producten mede door kappers worden gebruikt. Deze suggestie is misleidend nu deze producten geen kappersproducten zijn en ook niet door de kappersbranche worden gebruikt. Aanduiding professioneel kan in deze reclame-uiting niet als overdrijving worden beschouwd. Het College oordeelt, net als de Commissie, dat de gemiddelde consument op grond van de reclame-uitingen en de wijze waarop daarin naar kappers wordt verwezen, zal menen dat het om een product gaat waarmee, met inachtneming van de gebruikelijke overdrijving, een resultaat kan worden behaald dat lijkt op het resultaat van een kapper. Het College bevestigt de beslissing van de Commissie en wijst de klacht af.

Oordeel van het College:

1. De grieven lenen zich voor gezamelijke behandeling

2. KGA benadrukt in beroep dat sprake is van misleiding nu volgens haar de indruk wordt gewekt dat Syoss-producten mede door kappers worden verkocht en gebruikt hetgeen in werkelijkheid niet het geval is. Dienaangaande is van belang dat de onderhavige televisiecommercials steeds beginnen met beelden van - blijkbaar - kappers die in haarsalons het haar van modellen stileren. In het begeleidende commentaar wordt herhaaldelijk het woord “professioneel” genoemd.

3. Dat de Syoss-producten niet zijn bedoeld om (mede) door professionele kappers te worden gebruikt en verkocht, blijkt naar het oordeel van het College duidelijk uit de verdere inhoud van de uitingen, nu daarin wordt gezegd dat die producten bij supermarkt en drogist verkrijgbaar zijn waarbij wordt verwezen naar de beweerdelijk lage prijs van de producten. In de commercials is te zien hoe de modellen tijdens deze mededelingen Syoss-producten uit het winkelschap pakken. Indien met partijen ervan wordt uitgegaan dat ten aanzien van haarverzorging een strikt onderscheid bestaat tussen enerzijds de professionele kappersproducten (producten die exclusief voor kappers zijn bestemd en ook exclusief door die beroepsgroep worden gebruikt) en anderzijds de voor de consument bestemde retailproducten, alsmede dat de gemiddelde consument van dit onderscheid op de hoogte is, zal de consument reeds op grond van de mededelingen over de verkrijgbaarheid en de prijs van de Syoss-producten begrijpen dat deze producten retailproducten zijn die niet (mede) door kappers worden gebruikt en verkocht. De consument zal in plaats daarvan de beelden waarin kappers zijn te zien en de mededelingen waarin het woord “professioneel” wordt gebruikt in verband brengen met de van het gebruik van Syoss-producten te verwachten resultaat, zoals dat in de commercials aan de hand van  de modellen wordt getoond.

4. Het College onderschrijft op grond van het voorgaande  het oordeel van de Commissie dat de gemiddelde consument op grond van de reclame-uitingen en de wijze waarop daarin naar kappers wordt verwezen, zal menen dat het om een product gaat waarmee, met inachtneming van de gebruikelijke overdrijving, een resultaat kan worden behaald dat lijkt op het resultaat van een kapper. Ook in beroep is niet gesteld of gebleken dat de kwaliteit van de Syoss-producten een dergelijke suggestie niet zouden rechtvaardigen. Aldus is geen sprake van onjuiste of anderszins misleidende informatie die de gemiddelde consument ertoe brengt of zou kunnen brengen een besluit over een transactie te nemen dat hij anders niet had genomen.

5. Blijkens het voorgaande kan evenmin sprake zijn van schending van het vertrouwen in reclame. Tot slot heeft KGA geen inhoudelijke grief aangevoerd tegen het oordeel van de Commissie dat geen sprake is van vergelijkende reclame in de zin van artikel 13 Nederlandse Reclame Code (NRC), zodat ook in zoverre het beroep geen doel treft.

Ook Advertising Standards Authorization, de RCC in Groot Britannië, heeft een bundel uitspraken gepubliceerd. Categoriën variëren van ontharingssysteem, Palestina-reisorganisatie, houtbriquetten, museum, muziekband genaamd "HOLYFUCK" en opmerkelijk veel rondom een advertentie van een begrafenisonderneming.

Petfre (Gibraltar) Ltd - A TV ad for Betfred featured co-founder Fred Done. Mr Done said "I'll give you great odds and fantastic bonuses. Why? It's my fun and I love it. I'll even match your first bet up to £50. Watch my lips, a free bet up to £50, if you sign up today". On-screen text stated "Open online account, place £5 min bet, get free bet to same value, £50 max. T & C's apply, selected games. Free bet stake not included in returns".

Philips Electronics UK Ltd - A regional press ad for a hair removal system was headlined "And then there was light". Further text stated "Prevent hair growth with Philips Lumea. Scotts of Stow Ltd - Brochures distributed by direct mail promoted “The Original Gift Company”. The cover was designed in the style of a newspaper front page and referred to the recipient in the headline text and the article. The front page of one of the brochures was headed “MRS XXXX HELPS SAVE THE PLANET!”. Text at the bottom of the ad stated "Over 100 years of service to the community".

Channel Four Television Corporation - A poster for a Channel Four comedy show featured the title "TRAMADOL NIGHTS" which was written in the style of the fabric craft toy, fuzzy felt. The poster also featured fuzzy felt style images of a badger firing a machine gun, two rabbits attacking each other with hypodermic needles and another who had been stabbed with knives. The ad also featured an animal holding a chainsaw and pools of blood.

Medway Council - A leaflet, produced by Medway Council, promoted "Historic Rochester and Maritime Chatham". It was distributed in a local tourist information office. The front page featured a logo which stated "City of Medway rich heritage great future".

Myofascial Release UK - A leaflet, promoting training courses in a soft tissue therapy, was titled "INTEGRATED MYOFASCIAL THERAPY" and featured pictures of practitioners treating patients. Luv ncare Ltd - Two magazine ads for Nuby drinking cups. a. The first ad featured a picture of two drinking cups and was headlined "FREE† Nuby Grip'n'Sip CUP. CHOOSE FROM PINK OR BLUE”. Text in three bubbles underneath the products stated “ UK's No 1 Best Selling Silicone Spout”, “THE WORLD’S No. 1 CUP BRAND”, and “BPA FREE”.
