A magazine ad for organic farming that featured a man and his son dressed in a pantomime cow costume was headlined "We love organic because we care about animals". Text beneath quoted the man featured in the ad and said "I like to see myself as the brains of this outfit, even if my son doesn't agree! But when he told me about organic, well, I never looked back. Organic means fewer drugs or antibiotics, it also means better conditions for animals so they get to thrive and grow more naturally....

Moneysupermarket.com Ltd
Website and email for a financial products comparison service: a. The website included the text "“EXCLUSIVE CREDIT CARDS...Because we’re Britain’s No. 1 comparison site we have been able to negotiate great exclusive deals especially for moneysupermarket.com customers. Use our free, independent comparison to find the best offers you can’t find elsewhere.” On the page for all UK credit cards, the “Smart Search” feature was offered as an “Exclusive service” and stated “Get approved first time....

Lawrence of Kemnay Ltd
A regional press ad, for a car dealership, appeared on 3 March 2011. It was headlined “CUSTOMER SAVING £3400” and included an image of a car. Further text stated “new model fordfiesta edge 1.25 (60PS) 3-dr New on the road price £12,395 Our on the road price £8,995 HURRY - limited number available for immediate delivery on ‘11’ reg ... ”.

Stammering Cure
A website, on 5 April 2011, with the url www.stammeringcure.org. Text stated "... Discover how to stop stuttering with stammering cure that works ... You can Click Here Now to check out one thing that really helped me with my stammer ...". A number of hyperlinks on the website led to www.killyourstutter.com, a site which advertised a product that claimed to cure a stutter.

Webfusion Ltd
A website for domain names gave prices for various types of domain names including ".co.uk £2.99 a year". Text at the bottom of the home page stated "All prices Ex. VAT".

Virgin Media Ltd
a. A national press ad for Virgin Media seen in September and October 2010 stated "Fibre optic broadband £15 a month - It's official, Ofcom have proven our fibre optic broadband is around twice as fast as BT, Sky and Talk Talk's comparable packages, even at peak times†". The cross sign was linked to footnote text which stated "Source: Ofcom, July 2010. Virgin Media up to 10Mb broadband compared to competitors 8Mb or 10Mb broadband". b. Suntek Group
A marketer's own website, accessed on 16 April, stated "The best things in life are free ... like FREE SHIPPING! In addition to our recent storewide price reduction, we are now offering worldwide free shipping for all items and on all orders! No minimum purchase requirements!"

kgb (UK) Ltd
A sales promotion, on the kgb website, viewed on 28 March 2011. Text stated “£26 for a two-month supply of Acai Anti-Wrinkle Capsules worth £99.98 from i want to pay less - save 74%"

bmibaby Ltd
A promotional e-mail and a website for an airline promotion offering discounts on flights: a. The email ad stated "Gotta fly, baby! Up to 40% off ALL flights!" b. The website also stated "Up to 40% off ALL flights!". Terms and conditions at the bottom of the next page, after clicking on the promotion, stated "Offers available until Tuesday 22nd March. Up to 40% off applies to the airfare only and excludes airport taxes and charges".

Alegiance Services Ltd
An ad for a diet programme on the website www.dailyhealthalerts.com stated “Acai berries are the latest weight loss fad ... While there are ton’s [sic] of Acai berry ads online, Acai Diet Plus is one of the most credible and trustworthy suppliers on the market. It included the free* trial of the product and it did not try to fool me into agreeing to additional hidden offers”. See the table below to find out how we compare to these other high-street operators". The table compared Three's package to those of Orange, T-Mobile, Tesco, Virgin, Asda, Vodafone and O2.

Midland Van Conversions
Claims on a website for a van conversion company, in April 2011, stated "Based in the heart of England, Midland van conversions have over 40 years experience within the motortrade and specialise in the conversions of all makes of panel van". The 'Gallery' section of the website featured photos of different van conversions.

National Guild of Removers Storers
Text on the National Guild of Removers & Storers website stated "No other organisation or firm comes close to matching The Guild and its Members when it comes to consumer protection measures".

MyCityDeal Ltd
Two e-mails for Groupon deal of the day coupons: a. One e-mail, sent on 15 February, stated "£98 for £1650 towards Invisalign Teeth-Bracing Technology and Whitening at Q Clinic. View now For £98,00 [sic] Discount 94% Saving £1552,00 [sic]". Alfa Agency
Two online ads for an events recruitment company: a. The first ad, on the FRIDAY-AD website on 7 April 2011, was headlined "Alfa Agency Pr Events staff Models required work available ...". Text underneath stated "Alfa Agency Pr events staff Models required work available right now. Events/promotional staff/Models required for events. If you have any experience in these areas and wish to earn good rates, please email us with your CV and a photograph ... Currently we have positions to fill for...

Carlsberg UK Ltd
A prize promotion, on packs of Carlsberg, in January 2011, stated “Main Competition 2. There are 14 main prizes to be won in total. One prize will be won every week for the duration of the promotion. Each main prize consists of a 47 inch LG 3D TV, a Sky+HD box, a years subscription to Sky World and Sky+HD, and four pairs of 3D glasses. Resetten van DNA

RCC 3 mei 2011, Dossiernrs. 2011/00178 en 2011/00178A (Lancaster DNA)

Reclamerecht. Televisiereclame over 365 Cellular Elixer van Lancaster: "Reset elke dag het DNA van uw huid." Klager 1 stelt dat mededeling niet onderbouwd kan worden. Klager 2 stelt dat uiting misleidend is, DNA kan niet gereset worden. Verweerder stelt dat het product het herstel van beschadigd DNA in de huidcellen kan bevorderen en versnellen. Stelling uitgelegd en onderbouwd met onderzoeken.
Commissie oordeelt dat product bijdrage kan leveren aan herstel van beschadigd DNA. Dit rechtvaardigt niet de absolute claim "reset elke dag het DNA van uw huid." Sprake van onjuiste informatie (art. 8.2 aanhef NRC). Strijd met art. 7 NRC. Doet aanbeveling.

Gelet op het verweer acht de Commissie het aannemelijk dat het aangeprezen product een bijdrage kan leveren aan het herstel van beschadigd DNA, zoals dat herstel door de drie in door Coty aangehaalde natuurlijke herstelprocessen in meer of -naarmate de leeftijd stijgt- mindere mate wordt bewerkstelligd, met name in die zin dat het herstel wordt bevorderd en versneld. Deze bijdrage aan het herstel rechtvaardigt echter niet de absolute en niet kennelijk overdreven claim “365 Cellular Elixer reset elke dag het DNA van uw huid”.

Black Mountain Insulation Ltd
Claims in a brochure, titled "SHEEP'S WOOL INSULATION warmer safer smarter", viewed on Black Mountain Insulation's website on 7 February 2011, included "Man made insulation can only be disposed of into landfill; no recycling system is currently in place".

J Sainsbury plc
A national press ad, for a supermarket, was headed “3 for £10 Enjoy a glass with family and friends. Sainsbury’s Try something new today”. Below the header was a photograph of three bottles of wine. The bottles of wine were labelled “Hardys Bin 53”, “Mondelli Pinot Grigio” and “Mondelli Montepulciano D’Abruzzo”. At the foot of the image was a label which stated “£8.99 each”. 33% besparing, verkeerde berekening

RCC 13 april 2011, Dossiernr. 2011/00259

Reclamerecht. Aanprijzing voordeelpas zonnestudio: prijs €37,50, voor €50 euro zontegoed, save 33%. Klager stelt dat de besparing 12,50 is, dus maar 25% korting. Verweerder stelt: €37,50 + 33% = €50, dus stelling in uiting klopt. 
Commissie acht dat er sprake is van €12,50 korting dus 25% besparing op normale prijs. Sprake van onjuiste informatie (art. 8.2 onder d NRC) en daarom in strijd met art. 7 NRC.

In de bestreden uiting wordt de voordeelpas met een waarde van € 50,- aangeboden voor de prijs van € 37,50. Naar het oordeel van de Commissie zal de gemiddelde consument deze aanbieding begrijpen als een korting van € 12,50 op de reguliere prijs van € 50,-, wat neerkomt op een besparing van 25%.

Nu in de uiting wordt gesteld dat sprake is van een besparing van 33%, gaat de uiting gepaard met onjuiste informatie ten aanzien van het prijsvoordeel als bedoeld in artikel 8.2 onder d van de Nederlandse Reclame Code (NRC). Voorts is de Commissie van oordeel dat de gemiddelde consument hierdoor ertoe gebracht kan worden een besluit over een transactie – te weten de aanschaf van de voordeelpas – te nemen dat hij anders niet zou hebben genomen. Om die reden is de uiting misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

AH Bonusactie Syoss misleidend

Voorzitter RCC 12 mei 2011, Dossiernr. 2011/00202 (AH Bonus Syoss)

Reclamerecht. Bonusfolder AH met actie tweede product gratis van Syoss. Klager stelt dat uiting indruk wekt dat alle Syoss producten onder de actie vallen, echter de hairspray was uitgesloten. Verweerder erkent de klacht en wil product aan klager vergoeden. Voorzitter oordeelt dat Commissie klacht zal toewijzen. Overweegt dat er sprake is van onjuiste informatie (art. 8.2 aanhef en onder d NRC) en daarom in strijd met art. 7 NRC. Doet aanbeveling.

 De voorzitter is van oordeel dat de Commissie de klacht zal toewijzen. Hij overweegt daartoe het volgende.

Adverteerder heeft erkend dat de advertentie als misleidend kan worden opgevat, nu deze ten onrechte de indruk wekt dat de actie “2e gratis” ook geldt voor andere Syoss producten dan de twee in de Bonusfolder afgebeelde Syoss producten Gelet hierop is sprake van on­juiste informatie over het bestaan van een specifiek prijsvoordeel als bedoeld in artikel 8.2 aanhef en onder d van de Nederlandse Reclame Code (NRC). Voorts is de voorzitter van oordeel dat de gemiddelde consument hierdoor ertoe gebracht kan worden een besluit over een transactie te nemen, dat hij anders niet had genomen. Om die reden is de uiting mislei­dend en daar­door oneerlijk in de zin van artikel 7 NRC.

RB 890

1+1 actie Gilette bij Kruidvat misleidend

RCC 1 april 2011, Dossiernr. 2011/00150 (Gilette scheermesjes)

Reclamerecht. Uiting op website en uiting in winkel van Kruidvat over aanbieding 1+1 gratis op het gehele Gilette assortiment. Klager kocht twee 3-packs Gilette scheergel en moest de prijs van de twee producten betalen omdat volgens caissière de actie 1+1 gratis niet gold voor dit product. Nu dit niet bleek uit uitingen vindt klager deze misleidend. Verweerder stelt dat het ging om een actieverpakking en dat duidelijk is dat de 1+1 gratis actie niet voor actieverpakking geldt, dus vindt dat er geen sprake is van misleiding.

Commissie oordeelt dat er geen voorbehoud is gemaakt bij de 1+1 gratis actie en klager daarom terecht in de veronderstelling verkeerde dat tweede product gratis zou zijn. Acht de uiting onduidelijk (art. 8.2 aanhef en onder d NRC) en misleidend dus in strijd met art. 7 NRC. Doet aanbeveling.

 

De mededeling “1+1 gratis” betekent dat men bij aanschaf van één product, er één product gratis bij krijgt. Klager verkeerde, naar het oordeel van de Commissie, daardoor terecht in de veronderstelling dat hij bij aanschaf van een 3-pack Gillette Fusion scheergel een tweede 3-pack Gillette Fusion scheergel gratis zou krijgen. Bovenin de uiting staat dat de actie geldt voor een keuze uit het hele Gillette heren en dames assortiment en dat alle combinaties mogelijk zijn. Er wordt geen enkel voorbehoud gemaakt, ook niet in de verschillende asterisken waarnaar in de tekst wordt verwezen. Er was dan ook geen enkele reden om te veronderstellen dat de actie niet zou gelden voor een 3-pack Gillette Fusion scheergel. Nu de actie niet voor dit product blijkt te gelden, acht de Commissie de uiting misleidend.

Blijkens het voorgaande acht de Commissie de uiting voor de gemiddelde consument  onduidelijk als bedoeld in artikel 8.2 aanhef en onder d van de Nederlandse Reclame Code (NRC). Voorts is de Commissie van oordeel dat de gemiddelde consument hierdoor ertoe gebracht kan worden een besluit over een transactie te nemen, dat hij anders niet had genomen. Om die reden is de uiting misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

News Group Newspapers Ltd
A national press reader promotion for cosmetic products. The front-page flash stated "FREE EYE MAKE-UP KIT WORTH £24”. Inside the paper, text stated “... To claim your free Fabulous Models Own make-up kit, simply collect TWO out of the three tokens ... then collect your kit from any participating Tesco store* ... Terms and conditions apply". Yves Rocher - winkelier neemt aanbiedingspolicy niet over

Reclamerecht. Misleidende prijsvermelding in detailhandel. In kerstbrochure wordt shampoo aangeboden voor mini-prijs van €1,90 ipv €4,20. Klacht: aanbod geldt niet voor aankopen in vestiging, alleen voor aankopen via internet, blijkt niet uit brochure. Verweer: aanbiedingsprijzen worden ook gehanteerd in vestigingen (policy), winkelmedewerker heeft onjuist geïnformeerd, deze kerstaanbieding geldig zijn op de kerstbestelbon en zolang de voorraad strekt.

Commissie: De voorwaarde dat slechts per post, telefoon of internet besteld kan worden blijkt onvoldoende duidelijk uit de folder, uitsluitend onderaan de bestelbon en dit zal de gemiddelde consument ontgaan. In dit geval heeft winkelier niet de policy van de aanbiedingsprijzen gehanteerd, dus niet in alle Yves Rocher winkels kon de aanbieding worden afgenomen. Onjuist informatie ex 8.2 aanhef en onder d NRC misleidend en daardoor oneerlijk 7 NRC. Commissie doet aanbeveling.

De klacht heeft betrekking op een aanbieding in een folder. Volgens adverteerder kan men alleen van de aanbiedingen in de folder gebruik maken indien men  per post, telefoon of per internet bestelt. Naar het oordeel van de Commissie blijkt deze voorwaarde onvoldoende duidelijk uit de folder.  Deze voorwaarde staat blijkbaar uitsluitend onderaan de bestelbon in de folder. De Commissie acht het aannemelijk dat deze voorwaarde de gemiddelde consument zal ontgaan.
 
Overigens begrijpt de Commissie uit het verweer van adverteerder dat volgens een vaste policy klanten die in de winkel van de aanbiedingen in de folder gebruik wensen te maken, dat kunnen doen voor de in de folder vermelde prijzen. In het onderhavige geval heeft een winkelier echter aan deze policy geen gevolg gegeven, waardoor de klant geen beroep kon doen op de aanbiedingsprijzen.
 
Nu vaststaat dat men niet in alle Yves Rocher winkels producten kon kopen voor de in de folder afgebeelde prijs en de gemiddelde consument die het product in de winkel wil kopen hierop niet bedacht hoefde te zijn, is onduidelijke informatie verstrekt over de prijs van het aangeboden product als bedoeld in artikel 8.2 aanhef en onder d van de Nederlandse Reclame Code (NRC). Gelet hierop acht de Commissie de uiting misleidend en daardoor oneerlijk in de zin van artikel 7 NRC.

GlaxoSmithKline plc
A promotion on Lucozade packaging stated “WIN an iPhone EVERY HOUR*”. Smaller text stated “To be in with a chance of winning simply enter the code underneath the Best Before Date from the lid of your bottle.” The packaging also displayed a number of terms and conditions, including “Access to the internet and a valid email address are required in order to participate... Nuga Best UK Ireland
A leaflet, for a therapeutic couch with detachable gadgets, was titled "NUGA BEST”. Text beneath stated “BEST For Health! BEST for Beauty! BEST For Your Family! NUGA BEST NM-5000”. Klager denkt gebruik te maken v/e actie

Reclamerecht. Promotionele actie. Op de website van adverteerder staat: “Multifocale bril € 199,- (…) Wat u nog meer moet weten over dit aanbod * Geldig bij aankoop van een complete bril (…) * Bewerkingen (prisma toeslag, extra dunne glazen etc.) zijn niet bij de prijs inbegrepen * Geldig in combinatie met de zorgvergoeding van uw zorgverzekeraar” Klager heeft een bril gekocht á €294 bruto en €189,- netto.; zorgvergoeding voor een bril bedraagt €150 euro, maar ziet deze slechts €45 terug op zijn declaratie, misleiding. Nu blijkt dat er een bril is gekocht met geharde en ontspiegelde glazen, klager gaat er ten onrechte vanuit dat gebruik is gemaakt van de actie in de advertentie. Inmiddels is de resterende €105 ook overgemaakt aan klager. Commissie concludeert dat de klacht niet gaat over de overlegde advertentie en deze mist aldus feitelijke grondslag, wijst deze af.

Adverteerder stelt dat klaagster geen gebruik heeft gemaakt van de aanbieding die in de advertentie wordt vermeld. Hoewel klaagster dit betwist, kan uit hetgeen naar voren is gebracht niet worden afgeleid dat haar klacht betrekking heeft op de overgelegde advertentie. De bedragen sluiten niet aan en klaagster heeft niet de in deze advertentie bedoelde standaardbril gekocht, De klacht van klaagster mist derhalve feitelijke grondslag.
