iPod cadeau bij inschrijving

Reclamerecht. Uiting op de radio over inschrijven voor opleiding van LOI en daarbij een iPod cadeau krijgen. Klager stelt dat hij zich heeft ingeschreven, maar geen iPod kreeg omdat zijn cursusgeld minder dan 200 euro p.m. is. Verweerder heeft verweer gevoerd.

Voorzitter oordeelt dat Commissie klacht zal afwijzen. In uiting wordt nadrukkelijk verwezen naar actievoorwaarden op website. Gemiddelde consument zal deze voor aanschaf eerst raadplegen. Uit actievoorwaarden blijkt dat totale cursusgeld van 200 euro of meer leidt tot iPod cadeau. Wijst klacht af.

In de commercial wordt nadrukkelijk gewezen op de actievoorwaarden op de website. Van de gemiddelde consument kan worden verwacht dat hij, indien hij naar aanleiding van de bewuste actie geïnteresseerd raakt in een cursus, alvorens zich in te schrijven, eerst deze actievoorwaarden raadpleegt.

Uit de voorwaarden blijkt duidelijk dat men een iPod Shuffle ontvangt bij opleidingen met een lesgeldverplichting van € 200,- of meer (en overigens niet: € 200,- per maand, zoals klager stelt).

onrealistisch beeld en bijna een belediging voor Togaberoepen

Bij de Reclame Code Commissie is een klacht over het nieuwe reclamespotje van de NTI neergelegd door Groningse togamasterstudent, Sabine Korte. Het spotje waarin de cursisten continue gekleed in toga verschijnen acht ze misleidend. In't kort: Er wordt een HBO-studie aangeboden, dat heeft geen civiel effect, dus toga is misleidend. Daarbij is borrelen in toga is geen 'praktijkles'; ook is de NTI eerder op de vingers getikt in 2006.

 "Het is werkelijk een bijna lachwekkende reclame die van voor tot achter niet klopt. Het filmpje laat aanstaande cursisten in de waan dat men door middel van het volgen van een cursus bij het NTI werkzaam zou kunnen zijn in een van de togaberoepen, hoewel dit vanwege het ontbreken van het civiel effect niet mogelijk is", aldus Korte. Dat 'praktijkles' wordt neergezet als borrelen in toga is "onrealistisch en bijna een belediging voor togaberoepen.".

UPDATE: na contact met de RCC blijkt dat er reeds een soortgelijke klacht is geweest; RCC 10 maart 2011, Dossiernr. 2011/00116, hier(link), hier(pdf) en hier(doorzoekbare pdf)); commissie oordeelt dat er strijd is met art. 8.2 aanhef en onder b en dus art. 7 NRC (nieuw).
